TERMS AND CONDITIONS FOR INITIAL APPLICATION AND CONSENT FORM
These Terms and Conditions constitute a binding agreement between Lawyerspress.in, operated by the Lawyerspress Foundation through its Founder, Advocate Ajay Adiyogi Sharma, hereinafter referred to as the “Platform Owner”, and the Applicant, being an individual, association, or team applying for authorization to participate in the digital media initiative supervised by Lawyerspress.in.
By submitting this application, the Applicant hereby provides free, informed, and voluntary consent to be bound by the following Terms and Conditions and acknowledges having read and understood the same in full.
1. AUTHORIZATION AND LICENSE
1.1 Upon acceptance of this application, the Applicant shall be granted a provisional authorization to operate a digital legal news or blogging platform under the supervision and license of Lawyerspress.in for an initial trial period of one (1) month, extendable up to three (3) months at the discretion of the Platform Owner.
1.2 Continuation of authorization beyond the trial period shall depend upon satisfactory compliance with these Terms and prior written confirmation by the Platform Owner.
1.3 The Applicant shall constitute or designate a Local Media Team comprising practicing advocates from civil, criminal, or revenue branches, with one Head Member/Editor responsible for editorial supervision and adherence to these Terms.
2. EDITORIAL RIGHTS AND RESPONSIBILITIES
2.1 The Applicant and the Local Media Team shall have the right to access, create, and publish local and national legal news on the platform under the editorial oversight of Lawyerspress.in.
2.2 All publications, including blogs, news articles, or reports, must be original, factual, and lawful, and each author shall be individually responsible for the authenticity and accuracy of the content published under their name.
2.3 All contributors must comply with the provisions of the Advocates Act, 1961, and the Bar Council of India Rules, and shall refrain from commenting on sub judice (under-trial) matters.
2.4 Each published work shall clearly display the author’s name, photograph, and contact details.
2.5 The platform shall not be used for political promotion or campaigning. No content, image, article, or video supporting or opposing any electoral candidate or political party shall be published, except for duly authorized and approved paid advertisements.
3. CONTENT MODERATION AND ACCOUNTABILITY
3.1 The Platform Owner reserves the absolute right to review, edit, suspend, or remove any content published on the platform, either suo motu or upon receiving a complaint.
3.2 The publication of defamatory, inflammatory, obscene, communal, or objectionable material against any individual, group, or community is strictly prohibited.
3.3 Any person having a criminal background or pending criminal proceedings shall be ineligible for membership of the Local Media Team.
3.4 The Platform Owner shall not be held liable for any defamation, copyright infringement, or legal proceedings arising from content uploaded or published by the Applicant or its members.
4. TECHNICAL OWNERSHIP AND MAINTENANCE
4.1 The domain name, website, software, design, and intellectual property rights of the platform shall remain the exclusive property of Lawyerspress.in.
4.2 Failure to pay applicable renewal, maintenance, or service charges shall result in automatic termination of authorization, and all rights of the Applicant shall stand forfeited in favor of Lawyerspress.in.
4.3 The Platform Owner shall not be responsible for any data loss, server malfunction, or technical disruption. Restoration of the website or content shall be undertaken by the Applicant using available backups, without any claim for damages or compensation.
5. COMPLAINTS AND COMMUNICATION
5.1 The Applicant shall maintain a dedicated communication channel or WhatsApp helpline for public complaints, feedback, and responses.
5.2 All grievances shall be recorded and addressed within a reasonable period in accordance with principles of natural justice.
5.3 Any complaint or grievance against Lawyerspress.in shall be submitted in writing to the Platform Owner for review and appropriate action.
6. ADVERTISEMENT AND COMMERCIAL POLICY
6.1 No advertisement shall be displayed or published on the platform without the prior written approval of the Founder or an Authorized Officer of Lawyerspress.in.
6.2 The platform shall be utilized strictly for non-commercial, educational, or journalistic purposes, unless a separate Commercial License Agreement is duly executed.
6.3 Unauthorized advertisements, commercial use, or third-party sponsorships shall be deemed a material breach of these Terms, resulting in immediate suspension or termination of authorization.
7. DATA AND PRIVACY COMPLIANCE
7.1 The Applicant and its members shall comply with all applicable provisions of the Information Technology Act, 2000, the Indian Penal Code, and any other law in force concerning data privacy, cyber security, and digital publication.
7.2 Any misuse of personal data, unauthorized access, or breach of confidentiality shall render the Applicant liable to civil and criminal action under the relevant statutes.
8. LEGAL AND EDITORIAL LIABILITY
8.1 Each author, blogger, or media team member shall be individually responsible and legally liable for their content.
8.2 The Applicant shall not transfer, assign, or delegate publication rights to any third party without the written consent of the Platform Owner.
8.3 The Applicant acknowledges that it holds only user rights for operating the platform and has no proprietary, ownership, or intellectual property rights over the domain, content, or design.
9. TRAINING AND COMPLIANCE
9.1 The Applicant and its team members shall participate in training sessions, workshops, and media orientation programs conducted by Lawyerspress.in, either free or paid, as may be required.
9.2 The Applicant shall furnish a complete list of media team members, their names, contact details, and assigned responsibilities to Lawyerspress.in for record and approval.
10. DISPUTE RESOLUTION AND JURISDICTION
10.1 Any dispute, difference, or claim arising from or relating to these Terms shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, as amended from time to time.
10.2 The Arbitrator shall be a retired Judicial Officer or Senior Advocate appointed by the Platform Owner.
10.3 The seat and venue of arbitration shall be Kanpur, Uttar Pradesh, and the proceedings shall be conducted in English or Hindi.
10.4 Subject to the foregoing, the Courts at Kanpur, Uttar Pradesh, shall have exclusive jurisdiction over all disputes arising under these Terms.
11. MODIFICATION AND TERMINATION
11.1 The Platform Owner reserves the right to modify, alter, or amend these Terms at any time, and such modifications shall become effective upon communication to the Applicant.
11.2 In the event of any breach or violation of these Terms, the Platform Owner may issue a notice, suspend authorization, or terminate the Applicant’s license without prejudice to its other legal rights.
11.3 Termination of authorization shall not affect the ownership or intellectual property rights of the Platform Owner over the domain, website, or published content.
12. DECLARATION AND CONSENT
I, the undersigned Applicant, hereby declare that I have carefully read, understood, and voluntarily agreed to abide by all the Terms and Conditions mentioned hereinabove.
I affirm that all information furnished by me is true and correct to the best of my knowledge and belief, and I accept full legal and moral responsibility for compliance, ethical publication, and adherence to the policies of Lawyerspress.in.
